1. Service Description

Nookzo is a property listing platform operating in South Africa that connects property buyers, sellers, and renters with registered estate agents. The platform provides tools for listing properties, searching for properties, and facilitating communication between parties.

2. User Responsibilities

By using Nookzo, you agree to:

  • Provide accurate and truthful information
  • Maintain the confidentiality of your account credentials
  • Comply with all applicable South African laws and regulations
  • For agents: hold a valid Fidelity Fund Certificate (FFC) issued by the PPRA
  • For agents: ensure all listings comply with the Estate Agency Affairs Act
  • Not use the platform for fraudulent or illegal purposes

3. Listing Accuracy

Agents are solely responsible for the accuracy of property listings, including descriptions, pricing, photographs, and property details. Nookzo does not verify listing information and cannot be held liable for inaccurate or misleading listings. Buyers should verify all information directly with the listing agent.

4. Payment Terms

Founding agents receive free access during the founding agent programme. Once the programme ends:

  • Subscription fees will be charged monthly in advance
  • Pricing tiers will be communicated at least 30 days before billing begins
  • Payment is required to maintain active listings
  • Cancellation is permitted at any time with 30 days notice
  • No refunds for partial months

5. Intellectual Property

All content on the Nookzo platform, including logos, design, text, and software, is owned by AVENROQ Group (PTY) Ltd or its licensors. Users retain ownership of their uploaded content but grant Nookzo a license to display and distribute it on the platform. Users may not reproduce, distribute, or create derivative works from Nookzo's proprietary content without written permission.

6. Limitation of Liability

Nookzo provides the platform "as is" without warranties of any kind. We are not liable for:

  • Inaccurate or misleading property listings
  • Actions or omissions of agents or buyers using the platform
  • Transaction disputes between buyers and agents
  • Loss of data, revenue, or business opportunities
  • Service interruptions or technical issues

Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

7. POPIA Compliance

Nookzo complies with the Protection of Personal Information Act (POPIA). We collect and process personal information in accordance with our Privacy Policy. By using the platform, you consent to our data processing practices as described in our Privacy Policy.

8. Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to other users. Users may terminate their accounts at any time by contacting support.

9. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa, with jurisdiction determined by the location of our registered office in Johannesburg.

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or platform notification at least 14 days before taking effect. Continued use of the platform after changes constitutes acceptance of the new terms.
